Last month, a Florida man was killed by a spinning plane propeller at the Cleveland Regional Jetport. According to Cleveland Police Department public information, L.K., age 69, was found near his private plane with a severe head injury. He was rushed to the hospital where he later died. The plane involved in the incident was a Cessna 182.

The National Transportation Safety Board released its preliminary report on the accident, which says that L.K.’s wife was outside of the plane as he performed a preflight inspection of the aircraft. According to the report, L.K.’s wife heard the propeller move and what sounded like the engine trying to start. When she looked up, she saw her husband tumble to the ground and she called for help.

While this incident happened in Cleveland, the reality is that aviation accidents are also common in Florida. Aircrafts such as planes and helicopters are used for travel and recreational purposes. If you or someone close to you has been injured in an accident involving an aircraft, you may be entitled to compensation for your harm.

All aircrafts must be inspected, maintained and serviced regularly. Mechanical failures, human error and improper maintenance can all cause or contribute to an aviation accident. There are a number of legal theories that may be at play in your aviation accident case. When a defective product (i.e., an improperly designed propeller on a helicopter) is the cause of the accident, you may be able to file a products liability claim against the manufacturer or retailer. In these cases, a defendant is responsible for any harm that results from putting a dangerous product into the stream of commerce.

When a pilot or crewmember error is the cause of an accident, you may be able to file a personal injury lawsuit under the theory of negligence. Negligence occurs when someone causes an injury by breaching the duty of care (i.e., the level of care another person in the same or similar situation would have used).

Losing a loved is always tragic but the loss can be compounded by the fact that it could have been prevented. If you have lost a loved one due to someone else’s negligence, you need to reach out to a skilled Miami aviation accident  attorney without delay. At The Law Offices of Robert Dixon, we will guide you through every step of the legal process and fight for the compensation you rightfully deserve in your case.
