Dealing with Tire Blowout Accidents in Florida

A design defect is a flaw in the original scheme or design of the product that causes it to be unreasonably dangerous and create a risk for users. A design defect will typically be present in all of the manufacturer’s products. When a plaintiff alleges a design defect, he or she should assess whether the product’s design was unreasonably dangerous before it was even produced, whether it was plausible that the design could cause harm to a user, and whether the manufacturer could have used an alternative design that would have been safer but not excessively more expensive. If this standard seems likely to be met, the plaintiff may have a valid claim.
